By accessing or using the SecureSight Cam website, mobile application, or any products or services provided by SecureSight Cam (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not access or use our Services.

These Terms of Service constitute a legally binding agreement between you and SecureSight Cam regarding your use of our Services. We reserve the right to change these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

Our Services are designed to provide security and surveillance solutions for residential and commercial properties. By using our Services, you agree to the following terms:

Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services:

• In any way that violates any applicable federal, state, local, or international law or regulation.
• To monitor individuals without their knowledge and consent where such consent is required by law.
• To harass, abuse, or harm another person, or in a way that promotes discrimination.
• To impersonate or attempt to impersonate SecureSight Cam, a SecureSight Cam employee, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services.

Account Security

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You agree to notify us immediately of any unauthorized access to or use of your username or password or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

SecureSight Cam offers various subscription plans to access our Services. By subscribing to our Services, you agree to the following terms:

Payment Terms

All prices are in US dollars unless otherwise stated. We reserve the right to change our prices at any time. If we change our prices, we will provide notice of the change on the website or by email, at our option. Your continued use of the Services after the price change becomes effective constitutes your agreement to pay the changed amount.

Billing Cycles

For monthly subscriptions, you will be billed on the same day each month. For annual subscriptions, you will be billed once per year on the anniversary of your subscription start date. If your initial subscription begins on a day not contained in a subsequent month (e.g., January 31), you will be billed on the last day of that month.

Cancellation Policy

You may cancel your subscription at any time by logging into your account or contacting our customer support team. If you cancel your subscription, you will continue to have access to the Services through the end of your current billing period. We do not provide refunds for partial subscription periods.

SecureSight Cam provides the following warranties for our hardware products:

Limited Hardware Warranty

SecureSight Cam warrants that the hardware products you purchase from SecureSight Cam will be free from defects in materials and workmanship under normal use for a period of one (1) year from the date of purchase. This limited warranty is non-transferable and applies only to the original purchaser.

Warranty Exclusions

This warranty does not cover problems or damage resulting from:

• Accidents, abuse, misuse, or unauthorized repairs or modifications.
• Improper installation, operation, or maintenance not in accordance with product documentation.
• Products with missing or altered serial numbers.
• Normal wear and tear or cosmetic damage.
• Acts of God, power surges, or other events outside SecureSight Cam's reasonable control.

Software and Services Warranty

SecureSight Cam does not warrant that the Services will be uninterrupted or error-free. The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, in no event shall SecureSight Cam, its affiliates, directors, employees, agents, or licensors be liable for:

• Any indirect, special, incidental, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses.
• Any damages related to unauthorized access to or use of our servers or any personal information stored therein.
• Any interruption or cessation of transmission to or from the Services.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party.

In no event shall our total liability to you for all claims exceed the amount paid by you to SecureSight Cam during the twelve (12) months preceding the event giving rise to the liability.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above limitations may not apply to you.

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by SecureSight Cam, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

License Grant

Subject to these Terms, SecureSight Cam grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal or internal business purposes.

Restrictions

You may not:

• Modify, copy, or create derivative works based on the Services or any part thereof.
• Reverse engineer, decompile, or disassemble any portion of the Services.
• Remove any copyright or other proprietary notices from the Services.
• Transfer the Services or any part thereof to another person or entity.
• Use the Services for any purpose that is unlawful or prohibited by these Terms.

By using our Services, you agree to the following dispute resolution procedures:

Informal Resolution

Before filing a claim against SecureSight Cam, you agree to attempt to resolve the dispute informally by contacting us at legal@securesightcam.com. We will attempt to resolve the dispute by contacting you via email. If the dispute is not resolved within 30 days after submission, you or SecureSight Cam may proceed to formal dispute resolution.

Arbitration Agreement

All disputes arising out of or relating to these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules for arbitration of consumer-related disputes. The arbitration shall be conducted in Berkeley, California, unless you and SecureSight Cam agree otherwise. Each party will be responsible for paying any AAA filing, administrative, and arbitrator fees in accordance with AAA rules.

Class Action Waiver

You agree that any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis, and that you will not seek to have any dispute heard as a class action, representative action, collective action, or private attorney general action.

SecureSight Cam reserves the right to terminate or suspend your account and access to the Services at any time, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Effect of Termination

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Data Retention After Termination

After termination of your account, we may retain your personal information and user content for a commercially reasonable time for backup, archival, or audit purposes, or as required by law. Any information we retain will be handled in accordance with our Privacy Policy.

Refunds Upon Termination

If your account is terminated by SecureSight Cam for breach of these Terms, you will not be entitled to any refund of subscription fees. If you terminate your account, you may be entitled to a prorated refund of prepaid subscription fees for unused Services, at SecureSight Cam's sole discretion.
